Informe de Cuentas Financieras en el Extranjero (\u00abForeign Bank Account Report\u00bb)<\/p>\n

Hasta hace algunos a\u00f1os, el FBAR (Informe de Cuentas Financieras en el Extranjero, por sus siglas en ingl\u00e9s: Foreign Bank Account Report) pas\u00f3 de llamarse TD F 90-22.1, y ser un impreso en papel, a llamarse FinCEN Form 114<\/a>, teniendo que presentarse en l\u00ednea. Este informe se utiliza para documentar todas las cuentas financieras en el extrajero (fuera de EE.UU.), ya sean suyas en exclusiva, est\u00e9n compartidas, o si simplemente uno est\u00e1 autorizado o sea apoderado de una sociedad. Se trata solamente una declaraci\u00f3n informativa, por lo que en ella no aparece informaci\u00f3n que acarree responsabilidad fiscal alguna.<\/p>\n

 <\/p>\n

\u00bfQui\u00e9n debe presentar el FinCEN 114?<\/strong><\/h3>\n

Cualquier ciudadano de los EE.UU. o residente permanente (titular de una Tarjeta Verde o Green Card), que sea titular, cotitular o apoderado de una cuenta financiera fuera de EE.UU., y all\u00ed cuando la suma de los saldos m\u00e1ximos de todas las cuentas hayan superado los diez mil d\u00f3lares ($10.000) en cualquier momento del a\u00f1o. El monto se calcula, pues, tomando el valor m\u00e1s alto de cada cuenta financiera y sum\u00e1ndolos todos. La fecha l\u00edmite para la presentaci\u00f3n en l\u00ednea es el 15 de abril, m\u00e1s las extensiones que el contribuyente podr\u00eda haber solicitado al IRS para su Formulario 1040. En la actualidad, el Financial Crimes Enforcement Network acepta todas las extensiones ofrecidas por el IRS para su declaraci\u00f3n de impuestos.<\/p>\n

\u00bfHay sanciones por no presentar el formulario FinCEN 114?<\/strong><\/h3>\n

S\u00ed, hay sanciones muy duras por no presentar la FinCEN. Todo aqu\u00e9l obligado a presentar el FBAR que no lo haga correctamente puede estar sujeto a una sanci\u00f3n civil de diez mil d\u00f3lares ($10.000) por a\u00f1o no presentado, desde 1970.<\/p>\n
