FATCA fue sancionada como parte de una ley de empleo conocida como HIRE (\u201ccontratar\u201d). Se trata de una serie de reglas de amplio rango, bastante complejas, para posibilitar el mejor cumplimiento de la fiscalidad por los estadounidenses con activos fuera de los EE.UU. La ley fue redactada como respuesta al esc\u00e1ndalo bancario UBS de 2009, el cual revel\u00f3 que muchos estadounidenses ten\u00edan enormes participaciones financieras en cuentas de banco secretas suizas sin declarar o pagar impuestos en los EE.UU.<\/p>\n<p>&nbsp;<\/p>\n<p>La ley cre\u00f3 nuevos requisitos para la declaraci\u00f3n de impuestos personales e increment\u00f3 las multas en caso de no cumplir debidamente el nuevo reglamento. M\u00e1s a\u00fan, la ley impone un vasto mandato legal a todas las instituciones financieras extranjeras (es decir, no estadounidenses) para la determinaci\u00f3n de qui\u00e9nes de sus clientes son ciudadanos del EE.UU. y para informar directamente al IRS acerca de las cuentas de tales clientes. El mandato posee mecanismos draconianos para asegurarse de que virtualmente todas las instituciones financieras no estadounidenses cumplan con el reglamento. La ley incrementa notablemente las multas all\u00ed donde los contribuyentes no cumplen con las reglas pertenecientes espec\u00edficamente a activos financieros no estadounidenses.<\/p>\n<p>&nbsp;<\/p>\n<p>Los elementos principales de FATCA incluyen requisitos m\u00e1s onerosos en la declaraci\u00f3n y multas m\u00e1s elevadas. Pero m\u00e1s significativas son las exigencias a las instituciones financieras, que tienen el objetivo de que el IRS incremente la transparencia de todos los activos y transacciones extranjeras de los ciudadanos estadounidenses.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u00c9stos son algunos detalles espec\u00edficos de FATCA que afectan a los estadounidenses viviendo en le extranjero:<\/strong><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>Adem\u00e1s del presente Informe de Cuentas Financieras en el Extranjero (FBAR, por sus siglas en ingl\u00e9s: Foreign Bank Account Report), que es un requisito del Departamento del Tesoro estadounidense por el cual todos los ciudadanos de este pa\u00eds tienen que declarar activos financieros en el extranjero que excedan los diez mil d\u00f3lares ($10.000), FATCA requiere de los ciudadanos estadounidenses que declaren participaciones en el extranjero que excedan los trescientos mil d\u00f3lares ($300.000) mediante el Formulario 8938. Ambos requisitos son aplicables toda vez que los activos excedan las cantidades mencionadas <em>en cualquier momento del a\u00f1o<\/em>.<\/li>\n<li>Los nuevos requisitos de la declaraci\u00f3n impuestos por el IRS incluyen informaci\u00f3n detallada de todas las participaciones y transacciones bancarias. Las multas por no presentar el FBAR o el Formulario 8938 parten de los diez mil d\u00f3lares ($10.000) pero pueden elevarse mucho m\u00e1s dependiendo del tama\u00f1o de la cuenta corriente y de otras circunstancias.<\/li>\n<li>Todas las instituciones financieras no estadounidenses son requeridas a realizar informes muy detallados al IRS acerca de cuentas a nombre de ciudadanos estadounidenses; en caso de no cumplir est\u00e1n sujetas a la retenci\u00f3n de un 30% de todos los pagos de fuentes estadounidenses. La principal implicaci\u00f3n de esta provisi\u00f3n es que las instituciones financieras no estadounidenses pueden rechazar el servicio a ciudadanos estadounidenses.<\/li>\n<li>Cualquier ciudadano estadounidense que posea Compa\u00f1\u00edas de Inversi\u00f3n Pasivas Extranjeras (PFICs, por sus siglas en ingl\u00e9s, Passive Foreign Investment Companies) debe ahora declarar, mediante el oneroso Formulario 8621, cada una de las inversiones de la PFIC en el a\u00f1o. Anteriormente s\u00f3lo se requer\u00eda hacer la declaraci\u00f3n en los a\u00f1os en que se realizaban las distribuciones de la PFIC.<\/li>\n<li>El estatuto de las limitaciones para una auditor\u00eda del IRS se extiende de tres (3) a seis (6) a\u00f1os en aquellos casos en que se hayan omitido m\u00e1s de cinco mil d\u00f3lares ($5.000) de los ingresos brutos y cuando el monto puede ser atribuido a los activos extranjeros.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>La FATCA del 2010 cambia el juego de los estadounidenses en el extranjero<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>La\u00a0 FATCA entrar\u00e1 en vigor con toda su fuerza a lo largo del a\u00f1o 2017. Las instituciones financieras extranjeras han sido requeridas de hacer las declaraciones mencionadas desde 2014. Adem\u00e1s de las medidas relacionadas con la aplicaci\u00f3n de la FATCA, el IRS ha expandido su capacidad ejecutiva con respecto a los activos extranjeros de ciudadanos estadounidenses. El cumplimiento de la nueva FATCA y el ambiente de las declaraciones ha cambiado significativamente el juego de las inversiones y de la planificaci\u00f3n financiera.<\/p>\n<p>&nbsp;<\/p>\n<p>A causa de FATCA, los estadounidenses con activos financieros fuera de los EE.UU. deben asumir que el IRS tiene plenos poderes para ver tales activos con total transparencia. Muchas de las reglas especiales a activos extranjeros que durante d\u00e9cadas han podido ser ignoradas deben ahora recibir una atenci\u00f3n completa. Si no se comprende y cumple con esta nueva normativa se puede recaer en multas cuantiosas, impuestos atrasados, intereses y honorarios a abogados.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Pasos que, como ciudadano estadounidense, debes tomar inmediatamente a causa de FATCA:<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>1) Tener un plan de contingencia para cuando tu instituci\u00f3n bancaria local te informe de que, como ciudadano estadounidense, tienes que cerrar tu cuenta. El cumplimiento con la complejidad de FATCA se simplifica notablemente para tales instituciones si pueden probar que no tienen clientes de nacionalidad estadounidense. Los estadounidenses ser\u00e1n forzados poco a poco a confiar solamente en instituciones bancarias globales para transacciones financieras o servicios bancarios.<\/p>\n<p>&nbsp;<\/p>\n<p>2) Haz inventorio de todos los activos extranjeros e identifica cu\u00e1les est\u00e1n sujetos a un informe FATCA de la instituci\u00f3n correspondiente. Aseg\u00farate que tales activos no son PFICs o que se declaran incorrectamente como fideicomisos extranjeros. <em>Atenci\u00f3n<\/em>: las PFICs son mucho m\u00e1s comunes de lo que se suele creer, y pueden f\u00e1cilmente asomarse entre tus inversiones o incluso tus cuentas bancarias sin que lo sepas.<\/p>\n<p>&nbsp;<\/p>\n<p>3) Muda todas tus cuentas de inversi\u00f3n a instituciones financieras estadounidenses; ni tan siquiera lo hagas a sucursales extranjeras de tales entidades. Esto evitar\u00e1 las dificultades e incertidumbres que impone el cumplimiento de FATCA. M\u00e1s a\u00fan, aun dejando aparte el cumplimiento de FATCA, hay razones sustanciales para que los estadounidenses viviendo en el extranjero inviertan a trav\u00e9s de instituciones estadounidenses. Los mercados securitarios estadounidenses, con todas sus faltas, son todav\u00eda, con mucha diferencia, los m\u00e1s eficientes y acogedores para inversores en todo el mundo. Se puede componer una cesta completamente diversificada de activos globales con una simple cuenta de corretaje estadounidense a un precio mucho m\u00e1s bajo que en cualquier otra parte del mundo.<\/p>\n<p>&nbsp;<\/p>\n<p>4) Construye una cartera diversificada con exposici\u00f3n \u00f3ptima al riesgo y devoluci\u00f3n, as\u00ed como de divisas, de acuerdo con tu situaci\u00f3n financiera y tus planes de residencia a largo plazo. Generalmente, los inversores m\u00e1s j\u00f3venes deben asumir m\u00e1s riesgo en sus inversiones para maximizar las devoluciones a largo plazo. \u00a0La denominaci\u00f3n de las divisas en tus inversiones debe seguir el principio de armonizar inversiones con obligaciones para prevenir grandes oscilaciones en los valores de divisas en planes de jubilaci\u00f3n u otro tipo de ahorros.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=\u00bb1_4&#8243;
